You can certainly check with one of our appeals lawyers whether it is appropriate to apply to the Court of Appeal. Unlike that of other countries, the Canadian justice system does not allow for a new trial on appeal. The appeal courts are essentially there to verify whether the process which led to your conviction was fair and whether the applicable rules of law were respected. Exceptionally, the Court of Appeal may accept new evidence which was not presented at first instance. However, be aware that you only have one opportunity to assert your defense. In short, generally, a trial is won at first instance. It is therefore imperative to put the necessary resources and energy into the cause from the start of the procedures.

We believe that the legal aid system is not designed to ensure that each person benefits from the best possible defense. However, it is possible that we accept your file under the cover of a legal aid mandate. Our lawyers sometimes get involved pro bono in certain cases.
